Age Requirements & Verification

The purchase of Tobacco by persons under the age of 19 is prohibited by law. By placing an order through our website, you are representing yourself to us as at least 19 years of age and that the person to whom it is being shipped is at least 19 years old. We reserve the right to ask for proof of identity before processing an order.

Title to the Tobacco you order passes to you as soon as it leaves our doors; it is up to you to know the relevant laws in your state.

An adult signature with proof of age verification is required at time of delivery. Someone over the age of 19 must be available to sign for the package. If no one is available at the time of delivery, the package will not be left. Because of this, we suggest you ship to a work address.

Imagine a premium tobacco shop where:


  • The word "tobacco" could be deemed illegal and not allowed in retail tobacco shops' names!
  • Customers may not be allowed in humidors or to physically handle tobacco products!
  • Shop windows may have to be blacked-out!
  • Premium cigars may be required to be selected and sold from catalogs with only black and white photos!
  • Premium tobacco products may have graphic images of diseases on them!

These are ALL things that HAVE happened in parts of Europe and even closer to home-- in Canada. The very way you sell your tobacco products is in jeopardy.


Because of this threat, the Federal Food and Drug Administration (FDA) needs to hear from you! The agency is currently asking for the public's opinion and comments to help the agency develop its regulations to police and oversee the U.S. tobacco industry. While cigars and pipe tobacco are not currently included in the Family Smoking Prevention and Tobacco Control Act, they may ultimately be brought under FDA regulation.


We call on you, our customers, to tell the FDA such intervention and control is oppressive, anti-small business, and just anti-American!

Suggested Talking Points:


  • Congress recognized the fact that cigars and pipe tobacco do not pose the same public health concerns as the tobacco products outlined for regulation. FDA needs to recognize this important distinction as it implements the Tobacco Act.
  • Flavored cigarillos are manufactured and marketed to only adults as they are premium cigar tobacco and should remain as a legal adult choice product.
  • Kids don't smoke tobacco pipes; pipe smoking is an adult activity; there has not been a single study that has indicated any issue with kids smoking tobacco pipes.
  • Cigar and pipe consumers have the right to purchase and enjoy flavored premium products just as they have the right to purchase and consume flavored alcoholic spirits and other flavored alcoholic products.
  • Because of their artisan nature, origin, and construction, cigars are far different from cigarettes and are not consumed in the same way.
  • Cigars are a mature, adult social experience.
  • As most cigar and pipe tobacco businesses are owned and operated by small business owners and their families, further regulation will prove burdensome and overwhelming.
  • Simply because a product is flavored does not mean it is intended for or marketed to children.
  • For centuries, pipe tobacco has been flavored to create a wide variety of taste profiles enjoyed by adults.

  • Purchases are deducted from the Gift Certificate Balance.
  • Any unused balance will be placed in the recipent's Gift Certificate account when redeemed.
  • If an order exceeds the amout of the Gift Certificate, the balance must be paid with a Credit Card.

Limitations
  • Gift Certificates can NOT be redeemed for Cash.

Risk of Loss and Fraud

The risk of loss and title for Gift Certificates pass to the purchaser upon electronic transmission to the purchaser, recipient or deliver to the carrier, whichever is applicable. We are not responsible if a Gift Certificate is lost, stolen, destroyed or used without your permission.

Disputes

Any dispute relating an any way to Old Havana Cigar Gift Certificates in which the aggregate total claim for relief sought on behalf of one or more parties meets or exceeds $25.00 shall be adjudicated in any state or federal court in Floyd County, Georgia, and you consent to exclusive jurisdiction an venue in such courts.


Expiration
  • Gift Certificates generally expire 182 days or Six Months from the date of issue.
  • Gift Certificates may NOT be redeemed for purchases after the stated expiration date.

All of the information collected is used for the purpose of fulfilling customer orders, managing customer accounts, and to inform customers about site updates and specials.

Returns & Replacements

Returns Policy Overview

You may return new, unopened items within 5 days of delivery for a full refund. Items should be returned in their original product packaging. We'll also pay the return shipping costs if the return is a result of our error.

You should expect to receive your refund within Two Weeks after giving your package to the return shipper; however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (1 business day), and the time it takes your bank to process our refund request (1 to 3 business days). We'll notify you via e-mail of your refund once we've received and processed the returned item.


Replacements

If an order is delivered damaged, we will attempt to exchange it if the item is still available. However, if the item is no longer in stock we will issue a credit to the credit card originally charged.


Items that are Not Returnable

OldHavanaCigar.com does not accept returns where typographical errors in either descriptions or images may have been inaccurate.

OldHavanaCigar.com makes every attempt possible to accurately represent each and every product. But mistakes do happen, and some cases, such as flavor or strength are subjective. OldHavanaCigar.com is not responsible for any typographical or image errors.

How is Sales Tax Handled and Who pays them?

All of our Brick and Mortar Stores are located in Alabama and Georgia. Therefore if your shipping address is located inside Alabama or Georgia we are FORCED to collect State Excise Tax and Sales Tax. In Georgia the combined excise and sales tax is a hefty 30% (23% excise tax and 7% sales tax).

Yes I know this stinks…Our Government never misses an opportunity to reach into our pockets.

If you’re shipping address is outside of Alabama or Georgia. You the customer are responsible for sales tax due to your individual state.
